Abstract

O artigo busca conceituar os danos morais reflexos, distanciando-o de figuras próximas, mas que com ele não se confundem, como o dano-morte, sofrido pela vítima direta. Além disso, busca-se delimitar os obstáculos e as principais dificuldades para o seu reconhecimento. Finaliza-se concluindo que o principal obstáculo para o reconhecimento dos danos morais reflexos gira em torno de seu amplo potencial de expansão pela cadeia de pessoas atingidas por um mesmo ato ilícito. A solução para isso seria a redução equitativa da indenização, com fundamento no art. 944, parágrafo único, do Código Civil.
