
One of the major issues currently being debated around young offenders is that if it is a social or legal problem, since this problem should be considered not from the legal point of view but from the social field, because is not possible that a child is able to be judged when is not an adult and when he or she commits an offense or crime that is nothing else but the product of a generality of problems and events not attributable to him or her. With the current applicable law, instead of helping them, they are repressed, confused and confined what it prevents them to have a proper development.Uno de los grandes problemas que actualmente se debaten en torno a los menores infractores es que si es un problema de tipo social o legal, toda vez que este problema más que ser considerado desde el punto de vista legal debe analizarse desde el ámbito social, pues no es posible que a un niño se le pueda juzgar cuando aún no está formado, y cuando éste llega a cometer una infracción ò delito que no es sino el producto de una generalidad de problemas y acontecimientos no atribuibles a él, con la aplicación de la ley lejos de ayudarlo lo reprime, lo confunde y encima se le confina e impide que pueda tener un desarrollo adecuado.
