La justicia electoral y los pueblos indígenas en México

Abstract

En este texto me propongo analizar los alcances y los límites de la justicia electoral mexicana para el reconocimiento de los derechos políticos de libre determinación de los pueblos indígenas de México en la elección de autoridades municipales. A partir de la revisión de sentencias de la Sala Superior del máximo Tribunal Electoral del Poder Judicial de la Federación (TEPJF) analizo y discuto las formas en que están siendo procesados conflictos electorales que invocan el derecho a realizar elecciones por la vía de los llamados “usos y costumbres” y el sentido en que esto entra en conflicto con las normas del derecho electoral del ciudadano. Me interesa argumentar que si bien se notan importantes avances en las sentencias del poder judicial electoral federal para responder a los nuevos marcos legales que reconocen el pluralismo jurídico y los derechos colectivos, la mirada liberal de los derechos juega en contra del ejercicio del ejercicio de la libre determinación de los pueblos. Se corre por tanto el riesgo de reproducir nuevos colonialismos jurídicos en aras de garantizar la universalidad del sufragio en la elección de autoridades en municipios indígenas.
