Hacinamiento carcelario: reflexiones críticas en el constitucionalismo colombiano

Abstract

Este artículo intenta poner de presente una crítica de implicaciones ético-jurídicas que subyacen al momento de ser decretado, por parte de la Corte Constitucional colombiana, un estado de cosas inconstitucional frente al problema del hacinamiento en las cárceles. Se resalta no solo la vulneración masiva de derechos fundamentales, sino también la indiferencia con la que operan los ciudadanos en Colombia, que relegan a una minoría de la población que se vuelve vulnerable ante ese trato residual de la sociedad y de un Estado que se niega a resolver ese problema, aduciendo un déficit presupuestal y una incapacidad de sus instituciones para hacerle frente, atacando desde varios frentes la labor hecha por la Corte en esta trascendental sentencia.
