«Mundraub»: el hurto por extrema necesidad

Abstract

El «hurto por extrema necesidad» constituye una figura legal antigua en los códigos penales de Alemania, Suiza y Austria. Indicaba que, cuando lo la vida de una persona corría peligro, o amenazaba un daño irreversible a la salud de una persona por necesidad extrema y nadie ayudaba a esa persona, entonces ella tenía la posibilidad de robar lo que necesitaba, incluso aplicando la fuerza, siempre y cuando la persona robada no se encontraba en la misma situación precaria. Esta disposición legal se podía aplicar a situaciones de hambruna, carencia de ropa en el invierno frío, etc., como sucedía con frecuencia como secuelas de las guerras. Si bien esta legislación ya no consta en los códigos penales de los tres países mencionados, hoy en día adquiere una vez relevancia ética, pues gran parte de la humanidad se ve amenazada por el abuso en la fijación de los precios de medicamentos esenciales. Este ensayo ilumina los diversos aspectos de este problema, desde los Derechos Humanos, las patentes y hasta la Declaración de Doha.
