Abstract

O artigo tem como objetivo analisar a aplicabilidade das normas do Estatuto de Roma no Brasil, em face dos princípios constitucionais da reserva legal (art. 5º, II e XXXIX) e da irretroatividade da lei penal (art. 5º, XL). Tendo como objeto principal o julgamento do Recurso Especial nº 1.798.903/RJ, no qual os precedentes do Supremo Tribunal Federal foram suscitados, busca-se resposta aos seguintes questionamentos: seria possível considerar que as normas previstas nos artigos 7º e 29 do Estatuto de Roma são aplicáveis no Brasil? O país está violando os artigos 86 e 88 do Estatuto de Roma? O texto está dividido em três partes, nas quais, respectivamente, descreve-se a evolução jurisprudencial sobre o tema, conforme os argumentos levantados no Recurso Especial nº 1.798.903/RJ; em seguida, expõe-se a visão doutrinária concernente; e, por fim, sustenta-se uma posição tertium quid.
