La propiedad intelectual en el marco de los derechos de propiedad

Abstract

En la discusión sobre la propiedad intelectual existen dos corrientes de pensamiento: la que plantea que los derechos de propiedad se deben extender a la propiedad intelectual y la que propone que en lugar de la propiedad intelectual debiera existir libre acceso al conocimiento. En este artículo se presenta la visión de algunos de los autores que están inscritos en la primera escuela de pensamiento, es decir, aquellos que consideran que la propiedad intelectual es fundamental para el desarrollo de la economía del conocimiento. El texto está dividido en cuatro partes fundamentales: en la primera se discute la relación entre los derechos de propiedad y la economía de mercado; en la segunda se plantean las relaciones entre los derechos de propiedad y los bienes; en la tercera se establecen las relaciones entre los tipos de propiedad y la propiedad intelectual, y en la última se hace una mención sobre la importancia de entender las externalidades y el establecimiento de las políticas públicas.
