ОБʼЄКТ АРГУМЕНТАЦІЇ В ПРАВОВОМУ КОНТЕКСТІ: ОСНОВНІ КОНЦЕПЦІЇ Й ПІДХОДИ

Abstract

У статті здійснено осмислення внеску основних підходів у прийняття рішення в правовій аргументації шляхом короткого огляду основних концепцій відносно її обʼєкту. Обґрунтовано, що поняття «точка зору», як обʼєкт аргументації у правовому контексті не тотожно поняттям «висновок», «претензія», «пропозиція», «окрема думка судді».
