Abstract

Este artigo analisa, por meio de pesquisa bibliográfica e análise dos instrumentos internacionais relacionados à matéria, aspectos jurídicos envolvendo a relação entre o direito internacional do meio ambiente e o comércio internacional, reconhecendo na nova Diretiva Europeia de Devida Diligência em Sustentabilidade Corporativa mais um marco normativo que deve impactar as relações comerciais, os contratos internacionais delas decorrentes e, sobretudo, as cadeias de atividades das empresas, inclusive estrangeiras, que atuam na União Europeia. Nesse sentido, analisada a noção de lex mercatoria desde os seus primórdios, verificou-se que o entrelaçamento de ordens jurídicas de diversos níveis, inclusive supranacional, como é o caso da Diretiva, e a intervenção de organismos internacionais especializados em comércio internacional, produzem sensíveis efeitos nos contratos internacionais, fazendo com que as controvérsias decorrentes, especialmente em matéria ambiental, sejam projetadas também para as cortes de arbitragem. Na sequência, são analisados os principais pontos da Diretiva Europeia de Devida Diligência em Sustentabilidade Corporativa, bem como o seu papel no cumprimento das metas de sustentabilidade.
