Abstract

Luego de la década de los noventa y con el retorno a la democracia a inicios del nuevo siglo, en el Perú se llevaron a cabo un conjunto de intentos de reforma del Estado. El sistema de justicia no fue la excepción, ya que a lo largo de los últimos veinte años se elaboraron diagnósticos, propuestas de reforma y modificaciones normativas, que lamentablemente no lograron cumplir la promesa de transformación del sistema. A puertas del bicentenario, y con un nuevo proyecto de reforma iniciado a mediados del 2018, es necesario llevar a cabo un recuento y balance de estos veinte años de intentos de reforma, ensayando algunas de las posibles razones por las que estos fracasaron, no se implementaron o fueron dejados de lado en el debate público. En el presente artículo se elabora este recuento y balance, incorporando un marco conceptual necesario para pensar la corrupción en nuestro sistema de justicia.
