El sistema de derechos de necesidad y defensa en el Derecho penal

Abstract

El artículo intenta presentar una reconstrucción del sistema de causas de justificación derivadas de situaciones de necesidad dando cuenta de su estructura normativa y axiológica. Así, el sistema se estructura en relación a los principios que permiten justificar la configuración normativa de una situación, desde el punto de vista del agente, como obligación de abstención, permiso de lesión en situación de defensa o permiso de lesión en situación de necesidad. Dichos principios tienden a ser descritos mediante los conceptos de autonomía (formal), solidaridad y responsabilidad. El artículo muestra que a diferencia de los principios de autonomía y solidaridad, el principio de responsabilidad opera en un nivel lógico distinto (no descriptivo de normas de comportamiento, sino de normas de imputación), los que permiten fundamentar derechos de lesión derivados de autonomía de dos formas distintas (legítima defensa y estado de necesidad defensivo). Esa distinción puede ser justificada y permite, al mismo tiempo, superar problemas de consistencia dogmática que han afectado por largo tiempo a la dogmática penal.
