Derechos fundamentales y discapacidad

Abstract

La Convención sobre los derechos de las personas con discapacidad de Naciones Unidas impulsó en 2006 internacionalmente la visibilidad social de la discapacidad, y articuló sobre nuevos principios, vinculados a los derechos humanos, el tratamiento jurídico de la discapacidad. Entre estos valores se consagró especialmente el derecho a una vida independiente. En España, esta transición se apoyó en un incesante proceso normativo de adaptación, que culminó en 2024 con la reforma constitucional del artículo 49 CE. En el presente trabajo será objeto de reflexión esta reciente respuesta constitucional que contempla, desde un renovado discurso, inspirado en los principios de la Convención, el compromiso de los poderes públicos con los derechos fundamentales de las personas con discapacidad, y en particular, con la promoción de la autonomía personal, la accesibilidad universal y la inclusión social.
