Supremacía constitucional: enfoque teórico del conflicto de jerarquía, jurisdicción y competencia

Abstract

El derecho constitucional incluye principios de esencial interés para mantener el Estado de Derecho, por ello se planteó el objetivo de determinar teóricamente cómo influye la supremacía constitucional a encontrar soluciones a los conflictos de jerarquía, jurisdicción y competencia. Se aplicó la metodología bibliográfica, cuyos resultados indicaron que los principios de jurisdicción y competencia complementan al de jerarquía, el más importante y dirimente cuando se trata de controversias entre normas de distinto nivel jerárquico, caso contrario, puede considerarse los dos restantes, por asuntos de territorio o donde hayan concurrido dos o más tribunales o autoridades, que pueden resolverse a través de los órganos administrativos, judicial o legislativo, con mayor énfasis en este último órgano al que la Constitución le otorga la facultad para crear, derogar y reformar leyes. En conclusión, los conflictos de competencia pueden resolverse por medio de las decisiones de los órganos legislativos, administrativos o judiciales, mientras la jerarquía establece la validez de una norma superior jerárquicamente sobre una inferior, todos los cuerpos legales se deben ajustar a la normativa constitucional y no contradecir sus normas, para que la fuente de derecho sea la Carta Magna.
