Abstract

Se exponen los problemas de la actual regulación sobre los emblemas nacionales de Chile mencionados en la Constitución, leyes y reglamentos. Asimismo, aborda otras figuras de reciente aparición, como creación de la imagen corporativa del gobierno de turno y la instauración de los denominados símbolos regionales. En ambos casos, revisa cómo se han utilizado los emblemas en la realidad y los inconvenientes que ha provocado, apoyado por la jurisprudencia disponible. Asimismo, expone los recientes proyectos enviados al Congreso como parte de varias reformas constitucionales que tienen incidencia en los aspectos tratados. También, aborda tres casos en el derecho comparado con el objeto de examinar cómo se han resuelto problemas en la misma materia. Finalmente, se entrega una propuesta para conseguir una mejor regulación y un buen uso de estos emblemas por parte de los chilenos.
