Abstract

La primera Ley que trata la competencia y su defensa, entra en vigor en España en el año 1963 bajo el nombre de Ley de Represión de Prácticas Restrictivas de la Competencia. Esta Ley hizo precisa, debido a la generalización del mecanismo de mercado, al crecimiento de la economía y por consiguiente de las empresas, algunas de ellas, grandes empresas. Debido al incesante proceso de cambio, esta Ley quedará obsoleta y será en el año 1989 cuando entre en vigor la primera Ley de Defensa de la Competencia. En el año 2007, entra en vigor nuestra actual Ley de Defensa de la Competencia. Pasados doce años y después de muchas reuniones con sus pertinentes valoraciones acerca de nuestra ley, se llega a la conclusión de que se ha conseguido la efectividad deseada pero el acervo de directivas europeas requieren de nuestra legislación, no la derogación de la LDC, pero sí algunos ajustes para quedar conforme con el derecho europeo, mandato que opera para todos los estados miembros.

The first Law that deals with competition and its defense, came into force in Spain in 1963 under the name of Law for the Repression of Restrictive Practices of Competition. This Law is created on-demand, due to the market growth, the economy and consequently of compa- nies, since many of them will be large emerging companies. Due to constant change, this Law became obsolete and it would be in 1989 when the first Law for the Defense of Com- petition comes into force. In 2007, the present Law for the Defense of Competition came into force. After twelve years and many meetings with their pertinent evaluations about our law, the conclusion reached was the required effectiveness has been achieved, but, the list of European directives or he- ritage requires our legislation, not its abolishment, but some adjustments of the LDC, so it follows European law, a mandate in force for all member states.
