Abstract

Minor children of debtors are increasingly involved in disputes on bringing persons controlling the debtor to subsidiary liability, considered by arbitration courts within the framework of bankruptcy cases of legal entities. The article examines judicial practice in cases on bringing children of persons controlling the debtor to subsidiary liability for the obligations of a bankrupt company. The court brings children to subsidiary liability for the bad faith behavior of their parents. Protecting the interests of creditors, when considering cases on bringing persons controlling the debtor to subsidiary liability, the court should not neglect the rights and legitimate interests of their minor children.

В споры по привлечению контролирующих должника лиц к субсидиарной ответственности, рассматриваемые арбитражными судами в рамках дел о банкротстве юридических лиц, все чаще вовлекаются несовершеннолетние дети должников. В статье рассматривается судебная практика по делам о привлечении детей контролирующих должника лиц к субсидиарной ответственности по обязательствам общества-банкрота. Суд привлекает детей к субсидиарной ответственности за недобросовестное поведение своих родителей. Защищая интересы кредиторов суд при рассмотрении дел по привлечению к субсидиарной ответственности контролирующих должника лиц не должен пренебрегать правами и законными интересами их несовершеннолетних детей.
