
El presente trabajo pretende analizar qué posibles consecuencias tiene que hacer frente la empresa responsable de un producto defectuoso. Dentro de ellas, se hace especial hincapié al régimen de responsabilidad civil de productores o distribuidores, ofreciendo un estudio pormenorizado sobre las causas de exclusión de la responsabilidad del productor, posibles indemnizaciones por daños materiales y personales ocasionados por el defecto, etc. Además, se presenta el caso Johnson & Johnson, donde productor y distribuidor pertenecen al mismo grupo de empresas. Por otro lado, aunque muy relacionado con lo anterior, se describen aquellos costes económicos, directos e indirectos, que la empresa responsable podría tener que soportar una vez el producto defectuoso se ha comercializado. Entre ellos, destacan la notificación a las autoridades competentes sobre el producto inseguro, su retirada del mercado, el reemplazo o sustitución del bien, así como la posible pérdida de la confianza de los clientes en la compañía, de la imagen de marca, descenso del valor de las acciones en Bolsa, etc. De todo ello, se desprende que la finalidad perseguida es la protección del consumidor o usuario.
This paper aims to analyse what possible consequences the company responsible for a defective product has to deal with. Within these, particular emphasis is placed on the civil liability regime of producers or distributors, offering a detailed study about the causes for exclusion of the producer’s liability, the compensation for material and personal damages caused by the defect, etc. In addition, the Johnson & Johnson case, where producer and distributor belong to the same group of companies, is presented. On the other hand, closely related to the above, the direct and indirect economic costs the company behind may have to bear once the defective product has been commercialised are described. These include the notification of the competent authorities about the defective product, its withdrawal from the market, its replacement or substitution, as well as the possible loss of customer confidence in the company, the loss of the brand image, a drop in the value of the shares on the stock exchange, etc. From all this, the aim is to protect the consumer or user.
