Abstract

El artículo trata a respecto del deber positivo de investigar, juzgar y sancionardelitos internacionales de graves violaciones de derechos humanos por la vía del ius cogens. En este sentido parte del adagium nullum crimen nulla poena sine lege y cuestiona si, para evitar la impunidad, él debe se convertir en nullum crimen nulla poena sine iure (derecho internacional consuetudinário).
