Abstract

The following Final Undergraduate Thesis seeks to comprehensively study farm leases. In order to contextualise said topic, farm leases will be analysed from a historical point of view, observing their evolution through time. Having done so, this study will move on to focus on the 20 th century, paying special attention to the regulations applied from the entry into force of the Spanish Constitution in 1978 onwards. Additionally, the Spanish Farm Tenancy Act of 2003 will be thoroughly explained while considering its last modification in 2015. Farm leases will then be studied within the European framework and taking into account the current situation. Similarly, the difficulties arisen from today’s problems in modern agriculture will also be kept in mind, considering their impact on farm leases too. In the same trend of thought, rural properties and their relationship with renewable energy sources, solar panels mainly, will as well be observed. Finally, two court judgments resulting from current conflicts in real situations in which the Farm Tenancy Act is applied are also analysed as a way to conclude

En este Trabajo de Fin de Grado se realiza un estudio detallado de los arrendamientos rústicos. En primer lugar nos pondremos en situación analizando los arrendamientos rústicos con una perspectiva histórica, viendo su evolución a lo largo del tiempo. Después, nos centramos en el siglo XX y, más concretamente, en la normativa posterior a la entrada en vigor de la Constitución Española de 1978. Analizaremos con mayor detalle la Ley de Arrendamientos Rústicos del año 2003, teniendo en cuenta su última modificación del año 2015. Situaremos los arrendamientos rústicos en la perspectiva y momento actual, dentro del marco de la Unión Europea. Tendremos en cuenta las vicisitudes de hoy en día con las problemáticas de la agricultura actual y su impacto en los arrendamientos rústicos. Las fincas rústicas y su convivencia con las nuevas fuentes de energía renovables, sobre todo analizando las placas solares. Estudiaremos, para concluir, dos sentencias de conflictos actuales que se dan en situaciones reales a la hora de aplicar dicha Ley de Arrendamientos.
