Dictamen jurídico sobre los delitos de estafa y falsedad documental

Abstract

En el presente trabajo abordaremos el estudio de los delitos de estafa y falsedad documental, así como del delito continuado en el caso del primero, y el concurso de normas existente que se puede dar entre estas dos infracciones penales, de forma bastante habitual en la práctica, con la correspondiente pena en abstracto que podría acarrear el haber cometido estos ilícitos penales, y con una última breve mención a la responsabilidad penal de las personas jurídicas, al haber sido cometidos los hechos en el seno de una empresa. Para ello se han utilizado diferentes fuentes, desde comentarios al código penal, a manuales de la misma materia, así como un estudio jurisprudencial sobre algunas sentencias del tribunal supremo de interés. El objetivo principal de este dictamen jurídico ha sido examinar de forma concisa estas figuras delictivas, que surgen por la actuación del administrador de hecho de una sociedad.

In this essay we will deal with the study of the offenses of fraud and document fraud, as well as the continuous offense in the case of the former, and the existing concurrence of rules that can occur between these two criminal offenses, quite common in practice, with the corresponding penalty in the abstract that could result from having committed these criminal offenses, and with a final brief mention to the criminal liability of legal persons, as the facts have been committed within a company. For this purpose, different sources have been used, from commentaries to the criminal code, to manuals on the same subject, as well as a jurisprudential study on some rulings of the supreme court of interest. The main objective of this legal opinion has been to concisely examine these criminal figures, which arise from the actions of the de facto administrator of a company.
