Abstract

La Ley de Competencia Desleal de 1991 ha sufrido una importante modificación de resultas de la transposición de la Directiva 2005/29 CE efectuada mediante la Ley 29/2009. Entre los preceptos más destacados de esta reforma se encuentra el artículo 8, que contempla las llamadas prácticas agresivas como acto de competencia desleal. En concreto, este artículo establece que son actos de competencia desleal los comportamientos que se valen del acoso, la coacción o la influencia indebida si son susceptibles de mermar de manera significativa la libertad de elección o conducta del destinatario y, por lo tanto, de afectar a su comportamiento económico. Además, la disposición general en materia de prácticas agresivas del artículo 8 LCD se completa con la inclusión de las prácticas agresivas en la particular categoría de actos de competencia desleal que tienen la consideración de prácticas comerciales desleales con los consumidores, reguladas en los artículos 28 a 31 de la Ley. El objeto de este trabajo es el análisis de una modalidad de actos desleales, así como de las acciones que pueden ejercerse frente a las mismas.
