
En el presente trabajo se trata la problemática que presenta la institución del dolo eventual. El debate doctrinal se centra el dilucidar en qué elemento debe recaer el acento para resolver adecuadamente los casos prácticos en los que se aprecia la concurrencia de esa clase de dolo: el elemento volitivo o el cognitivo. En este estudio se recogen las diferentes teorías, así como la evolución de la jurisprudencia de nuestro Tribunal Supremo y la aplicación de esta institución en diferentes categorías de delitos. Se concluye haciendo una referencia a la institución de la recklessness en el Derecho inglés, figura similar a nuestro dolo eventual.
This paper considers the problems presented by the institution of eventual fraud. The doctrinal debate focuses on clarifying which element should be emphasized in order to properly solve the practical cases in which the concurrence of this type of fraud is appreciated: the volitional or cognitive element. In this study the different theories are compiled, as well as the evolution of the jurisprudence of our Supreme Court and the application of this institution in different categories of crimes. It concludes with a reference to the institution of recklessness in English law, a figure similar to our eventual fraud.
