Abstract

S'appuyant sur la réflexion critique récente portant sur la juridiction, cette thèse considère le discours du droit ou l’énoncé de la loi (juris-diction) comme une technologie de ce que Michel Foucault appelle “gouvernement”. La première partie de la thèse explore de façon allégorique le fonctionnement des ordinateurs et réseaux numériques et propose de passer d'un concept de code comme configuration d'instructions écrites envoyées à des ordinateurs numériques à une conception du code comme langage réglementaire utilisé par les opérateurs des ordinateurs. La deuxième partie de la thèse part des notions de loi comme discours dans la pensée juridique critique en repensant l'utilisation des langages réglementaires comme pratique citationnelle par laquelle la juridiction est assumée, affirmée et exercée. Dans une enquête allégorique sur les dynamiques internes d'Airbnb, la deuxième partie découvre le domaine comme un complexe d'actions qui se conditionnent les unes les autres, « réalité transactionnelle » née à l’interface des gouvernants et des gouvernés . Chaque action effectuée par des utilisateurs de l'interface fait une différence qui modifie l'ordre des recherches à venir, l'ordonnancement du marché d'Airbnb et le partage de ses ressources. Chaque clic de souris, chaque touche enfoncée et chaque contact avec l'écran est un acte de gouvernement, à la fois exécution d'un code et ce qui le transforme, et acte d'encodage.

Drawing on recent critical reflection on jurisdiction, this dissertation considers law’s speech or the speaking of law as a technology of what Michel Foucault calls “government.” The first part of the dissertation allegorically explores the operation of digital computers and computer networks, proposing a shift from a concept of code as a configuration of written instructions to digital computers to a conception of code as a regulatory language used by computer operators. The second part of the dissertation takes as its starting point notions of law as discourse in critical legal scholarship, rethinking the use of regulatory languages as the citational practice by which jurisdiction is assumed, asserted, and exercised. Allegorically investigating Airbnb’s internal dynamics, Part II discovers the domain as a complex of actions that condition each other, a “transactional reality” born at the interface of governors and governed. Each and every action taken by users of the interface, the argument goes, makes a difference, affecting the ranking of future search results, the ordering of the Airbnb market, and the distribution of resources within it. Each and every click on the mouse, keystroke, and tap on the touchscreen is an act of government, both an execution of code and what transforms it, an act of coding.
