Abstract

В статье анализируется структура и содержательная схожесть концепции законопроекта и пояснительной записки, их роль в обеспечении эффективного законотворческого процесса в Украине. Указывается, на тот факт, что концепция законопроектов не стала распространенным инструментом обеспечения качественного законотворческого процесса, и фактически заменяется пояснительной запиской к законопроекту, которая внешне упрощает процесс законотворчества, но реально его обесценивает. Обращается внимание на фрагментарность нормативно-правового регулирования законопроектной деятельности в Украине. В статье обосновывается необходимость конкретизации структурных элементов поясняющего законопроект документа, что должно минимизировать формальность и поверхностность в разработке законов и повысить эффективность законодательной деятельности, а также будет способствовать прогнозированию результатов его действия.

The article analyzes the structure and substantial sameness of the bill and the explanatory note of the bill, their role in ensuring effective legislative process in Ukraine. The article points out the fact that the concept of the bill does not become a common instrument for ensuring quality of the legislative process, and in fact replaced with an explanatory note to the draft law, which outwardly simplifies the process of law, but in reality it depreciates. Рay attention to the fragmented regulatory legislative activities in Ukraine. In the article explains the necessity of concretization the structural element of the bill explanatory document, what should minimize the formality and superficiality in designing laws and improve the efficiency of the legislative activity, and will also help to predict the results ofhis actions.
