¿Permanecen la Instr. Dignitas connubii y el Tribunal de la Rota de la Nunciatura Apostólica en España después de la reforma del proceso de declaración de nulidad matrimonial (Mitis Iudex Dominus Iesus)?

Abstract

El M.P. Mitis Iudex no ha revocado la Instrucción Dignitas connubii que permanece en vigor si está materialmente reproducida sin cambio sustancial. En todo caso, en la duda sobre si se dio o no esa revocación o cese de eficacia de la Instrucción, habrá que mantener como cierto en la práctica que no se dio tal revocación. Por otra parte, Mitis Iudex no contiene norma alguna que sea contraria a alguna norma pontificia de Juan Pablo II sobre el actual Tribunal de la Rota Española y una norma del M.P. Mitis Iudex o del rescripto en cuestión que fuera contraria a alguna norma pontificia de estas de Juan Pablo II, no la revocaría si, además de ser contraria, no dijera expresamente que la revoca. Por tanto, no hay razones objetivas válidas para afirmar que el privilegio de la Rota de la Nunciatura Española ha sido revocado por la posterior legislación del actual Papa Francisco. Así este glorioso tribunal podrá seguir prestando valiosa ayuda a los españoles cuyo matrimonio canónico, presuntamente válido en el fuero externo, presenta y tiene síntomas de objetiva nulidad.
