Abstract

الملخص: يتناول هذا البحث التحول الرقمي للوسائل البديلة لحل المنازعات بوصفه أحد المداخل الأساسية لتخفيف العبء عن القضاء وتحقيق عدالة ناجزة ومرنة. ويحلل البحث الأطر القانونية والتنظيمية التي تحكم الوسائل الرقمية للتوفيق والوساطة والتحكيم، مع التركيز على ضمانات الرضا، والسرية، وحجية الاتفاقات الإلكترونية. كما يناقش التحديات التقنية المرتبطة بأمن المعلومات، وحماية البيانات، وإثبات الهوية الرقمية للأطراف. ويبرز البحث أهمية دمج تقنيات الذكاء الاصطناعي والمنصات الرقمية في منظومة تسوية المنازعات، شريطة تطوير تشريعات مرنة تواكب هذا التحول وتحمي الحقوق الإجرائية للأطراف. Abstract : This study addresses the digital transformation of alternative dispute resolution (ADR) mechanisms as a key approach to alleviating judicial caseloads and achieving flexible and efficient justice. It examines the legal and regulatory frameworks governing digital mediation, conciliation, and arbitration, with particular emphasis on consent, confidentiality, and the enforceability of electronic agreements. The paper also discusses technical challenges related to information security, data protection, and digital identity verification. It highlights the importance of integrating artificial intelligence and digital platforms into ADR systems, provided that adaptive legal frameworks are developed to safeguard procedural rights.
