Abstract

This report consists of three complementary elements. (1) a market study of the e-Lending market, reviewing existing empirical data, as well as analysing a sample of licensing contracts and interviews with library professionals in four European countries (Denmark, Poland, Republic of Ireland and the UK); (2) an analysis of the practices identified in the market study under EU competition law, in particular with respect to the exercise of potentially abusive market power; and (3) an analysis of copyright law, with a focus on potential solutions that could address the market issues identified.
