COMPETÈNCIES AUTONÒMIQUES EN MATÈRIA DE JUSTÍCIA: ESTAT DE LA QÜESTIÓ

Abstract

This article examines the powers over the judiciary held by the autonomous communities by analyzing the legal and case-law evolution on the matter, as well as the current situation. Although the Spanish Constitution conferred Central Government with exclusive powers over the judiciary and administering of justice, the autonomous communities, by means of their charts (statutes of autonomy), assumed some minor powers. In 1990, the Spain’s Constitutional Court solved this apparent contradiction by establishing a difference between the judiciary and administering of justice strictly speaking, reserved exclusively to Central Government, and the administrative support required to implement it (staff and material resources), on which the autonomous communities were allowed to hold limited powers, as they did. The 2006 Statute of autonomy of Catalonia attempted to overcome such limitation, although expressively manifesting subjection to the Spanish constitutional law on the Judiciary. Actually, the strictness to this subjection was the principal reasoning the Constitutional Court argued in its 2010 ruling of about the 2006 Statute of autonomy of Catalonia (Ruling 31/2010) to reject the unconstitutionality of these sections of the Statute which aimed at attributing greater powers to Catalonia on the matter. Even more, some recent rulings by the Constitutional Court dismissed the new sections of the Statute that were left after the 2010 ruling. Therefore, the autonomous communities could only have greater powers on the matter by means of a reform of the Spanish constitutional law on the Judiciary, and, from a broader perspective, of a constitutional reform which would change the present unitary structure of judiciary system.

El artículo examina las competencias autonómicas en materia de justicia a partir de la evolución normativa y jurisprudencial de las últimas décadas y del análisis de los títulos competenciales actualmente vigentes. La CE atribuyó al Estado la competencia exclusiva en la Administración de justicia, pero la mayoría de estatutos incluyeron competencias en la misma materia. En el año 1990 el TC resolvió esta aparente contradicción, al diferenciar la Administración de justicia en sentido estricto y los medios personales y materiales que están a su servicio, ámbito en el que se proyectan la mayor parte de las competencias autonómicas, si bien con importantes límites. El EAC de 2006 intentó superar estos límites, pero en muchos casos con explícita sujeción a la LOPJ. Esta sujeción a la LOPJ constituye el argumento principal de la STC 31/2010 para rechazar la inconstitu¬cionalidad de las normas estatutarias atributivas de competencia, y los pronun¬ciamientos más recientes del TC parecen no tener en cuenta los nuevos títulos competenciales del EAC. Un incremento significativo del ámbito competencial en la materia sólo se conseguirá, por tanto, mediante la reforma de la LOPJ, y, desde una perspectiva más amplia, mediante una reforma constitucional que altere la actual estructura unitaria del poder judicial

L’article examina les competències autonòmiques en matèria de justícia, a partir de l’evolució normativa i jurisprudencial de les darreres dècades i de l’anàlisi dels títols competencials actualment vigents. La CE va atribuir a l’Estat competència exclusiva en l’Administració de justícia, però la majoria d’estatuts van incloure competències en la mateixa matèria. L’any 1990 el TC va resoldre aquesta aparent contradicció, en diferenciar l’Administració de justícia en sentit estricte i els mitjans personals i materials que estan al seu servei, àmbit en el qual es projecten la major part de les competències autonòmiques, si bé amb importants límits. L’EAC de 2006 va intentar superar aquests límits, sovint, però, amb explícita subjecció a la LOPJ. Aquesta subjecció a la LOPJ constitueix l’argument principal de la STC 31/2010 per rebutjar la inconstitucionalitat de les normes estatutàries atributives de competència, i els pronunciaments més recents del TC semblen no tenir en compte els nous títols competencials de l’EAC. Un increment significatiu de l’àmbit competencial en la matèria només s’aconseguirà, doncs, mitjançant la reforma de la LOPJ, i, des d’una perspectiva més àmplia, mitjançant una reforma constitucional que alteri l’actual estructura unitària del poder judicial.
