Abstract

El objeto de estudio de la presente Tesis doctoral se centra en "Los límites de los derechos fundamentales en los Estados de excepción según el Derecho Internacional de los Derechos Humanos"(sistema universal y regional europeo e interamericano) Dichos sistemas desarrollan las facultades de suspensión o derogación de derechos, que tienen como fundamento la "estricta necesidad" de superar crisis particularmente graves e insuperables por las vías legales ordinarias, restablecer la normalidad y garantizar el normal funcionamiento de las instituciones democráticas, la vigencia del estado de Derecho y la protección de los Derechos Humanos de la colectividad. El Derecho Internacional convencional de los Derechos Humanos faculta a los estados a suspender temporalmente ciertas obligaciones jurídicas internacionales, pero a su vez les exige cumplir con ciertos principios y disposiciones con el fin de adecuar las medidas excepcionales a lo estrictamente indispensable para el restablecimiento de la normalidad constitucional. La regulación convencional de las facultades de suspensión de derechos de los sistemas universal y regionales, si bien ha alcanzado un desarrollo positivo, no responde en la actualidad a las exigencias de protección de los derechos y garantías fundamentales, por lo que se requiere de una revisión de las normas convencionales y mecanismos de protección internacional.
