El trabajo pretende exponer de forma breve una de las principales novedades de la fase inicial del concurso voluntario. En éste, el deudor no sólo puede, sino que debe de iniciar oportunamente. El cumplimiento de ese deber no resulta, sin embargo, sencillo, sobre todo en la insolvencia de sociedades mercantiles. En ésta, la iniciación del concurso se relaciona, y así se apunta en el trabajo, con cuestiones de responsabilidad y de colaboración entre los órganos sociales. Todo ello se fundamenta y parte del conocimiento del estado de insolvencia, inminente o actual, por el deudor o sus administradores y socios.The present paper aims to briefly describe one of the main new features of the initial phase of the voluntary insolvency procedure. At this stage, debtor is not just allowed, but obliged to properly initiate the procedure. However, this obligation is not easy to fulfil, mainly with respect to the insolvency of corporations. In this type of cases, the initiation of the procedure is related to liability and collaboration of the corporate bodies. All this is based and departs from the accurate understanding of the insolvency state, imminent or actual, by the debtor or its managers and partners.
