Abstract

L’auteur démontre que l’élément clef qui définit l’existence d’un système politique démocratique est le fait que la Constitution et les lois soient le produit de la volonté majoritaire du peuple, exprimée en assemblées qui le représentent à travers un vote qui possède réellement la même valeur. Il soutient que pour le Chili actuel il est évident que la Constitution ne correspond pas à un produit de la volonté majoritaire du peuple car elle fut imposée par la dictature lors d’un plébiscite illégitime, et car son contenu correspond à un régime autoritaire. L’auteur, tout en développant ces arguments, critique la manière dont les gouvernements concertacionistes ont déclaré conclue la transition à la démocratie.

El autor argumenta que el elemento clave que define la existencia de un sistema político democrático es el hecho que la Constitución y las leyes sean el producto de la voluntad mayoritaria del pueblo, expresada en asambleas que lo representen a través de un voto que tenga realmente el mismo valor. Sostiene que para el Chile actual es claro que la Constitución no es el producto de la voluntad mayoritaria del pueblo pues fue impuesta por la dictadura en un plebiscito espurio, y sus contenidos configuran un régimen autoritario. El autor junto con desarrollar estas ideas cuestiona cómo los gobiernos concertacionistas fueron dando por realizada la transición a la democracia.

The author argues that the key element that defines the existence of a democratic political system is the fact that the Constitution and the laws are the product of the majority will of the people, expressed in assemblies that represent them through a vote that has really the same value. He argues that in present Chile it is clear that the Constitution is not the product of the will of the majority because it was imposed by the dictatorship in a spurious plebiscite, and its contents constitute an authoritarian regime. The author along with developing these ideas, questions how the Concertación governments defined that the transition to democracy had been accomplished.
