Se presenta a continuación una investigación de Tesis que se ha basado en la complementación de dos elementos materiales: la experiencia en la evaluación de procedimientos de evaluación de denuncias en el ámbito del Ministerio Público y la experiencia profesional desarrollada en la actividad laboral en la cual desarrollamos elementos propios de la argumentación jurídica y sobre la cual hemos ubicado un contexto problemático específico: la fundamentación de las impugnaciones no requeridas al ciudadano que formula una denuncia generan un problema material a las expectativas del ciudadano porque el Fiscal Superior, sobre la base de lo que ha ejecutado el Fiscal Provincial prácticamente decide de la misma manera y por tanto el ciudadano se considera afectado por tal decisión. Ante este contexto y sobre la base de la evaluación de un ámbito geográfico, institucional y temporal específico se evalúa la razonabilidad de ejecutar una investigación que nos permita complementar elementos teóricos del ámbito constitucional, procesal y penal con la argumentación jurídica y hemos observado que las exigencias que se imponen al ciudadano son distintas a las que se imponen al magistrado, en el caso de la Tesis: al fiscal. Esto debido a la necesidad de garantizar el Estado de Derecho, conforme se podrá determinar en el desarrollo de la investigación, la misma que procura desarrollar un esquema lógico en cuanto al desarrollo del marco teórico para así poder facilitar la evaluación de un contexto particular y sobre ella determinar la hipótesis de la investigación.
