El comercio ilegal de prendas de vestir con marcas registradas : análisis de la coordinación entre las fiscalías especializadas y la Dirección de la Policía Fiscal en el período 2014-2015

Abstract

En los últimos años en Lima Metropolitana y específicamente en el emporio comercial de Gamarra del distrito de La Victoria, el comercio ilegal de prendas de vestir con marcas registradas se ha incrementado. Esta actividad ocasiona perjuicios económicos al erario nacional debido a que los comerciantes eluden el pago de impuestos. De igual forma, genera perjuicios económicos a las empresas constituidas y comercios formalizados, quienes venden menor cantidad de prendas de vestir originales. Por consiguiente, al reducirse sus ventas, perciben mínimos ingresos económicos. Este comercio ilegal es evidente, notorio y público, y se desarrolla con conocimiento del gobierno nacional, regional y local. A pesar de su incremento, no se tiene la oportuna respuesta del Estado al citado problema. Debido a la situación problemática que se presenta, esta tesis planteó estudiar la coordinación entre las Fiscalías Especializadas en Delitos Aduaneros y Contra la Propiedad Intelectual1 y la Dirección de la Policía Fiscal2, organismos públicos encargados de prevenir, combatir y erradicar el comercio ilegal de prendas de vestir con marcas registradas.
