Abstract

La existencia del Tribunal Internacional de Derecho del Mar se encuentra prevista en la Convención de Derecho del Mar de 1982 (Convemar). Técnicamente este tribunal no pertenece al sistema de Naciones Unidas ya que no surge de su carta constitutiva, como sí sucede con la Corte Internacional de Justicia, no obstante se puede considerar como un órgano jurisdiccional, pero no judicial, sin embargo ello no impide que celebre determinados acuerdos con las Naciones Unidas (a). El TIDM inició sus funciones en 1996 y actualmente este tribunal tiene su sede en la Ciudad Libre y Hanseática de Hamburgo, República Federal de Alemania. El mismo provee a los Estados partes de la Convención un mecanismo de solución pacífica de controversias. Lo más importante de destacar es que hoy en día se cuenta con un tribunal internacional específico en asuntos marítimos, cuya competencia no sólo se encuentra abierta a los Estados, sino que también a las Organizaciones Internacionales y a las personas físicas y jurídicas, estas últimas bajo determinadas circunstancias. Además la competencia de la CIJ (Corte Internacional de Justicia) “podría ser modificada” por éste tribunal del mar. Un detalle principal si consideramos que ante un caso llevado por la CIJ relativo a la interpretación, aplicación de la convención o de otra índole, un Estado podría oponer como excepción la incompetencia de la CIJ. The ITLOS was established according to the United Nations Convention of the Law of Sea, 1982. This Tribunal not belong to United Nations system, is for that it can be called “a jurisdictional tribunal”. ITLOS starts its functions in 1996, is situated in the Hanseatic and Free City of Hamburg, Germany. Its existence provides the States parts of the Convention a pacific controversies solution mechanism. Briefly, the importance point of ITLOS is that nowadays there is a specific international tribunal on maritime affairs, whose competence is not only open to States, even International Organizations, juridical and human persons under some circumstances. A part from that the ICJ´s competence (International court of Justice) “could be modified” by this tribunal of sea. A main detail if we consider in a concerning case lead by ICJ, a State can oppose to his competence when the “ratione materiae” of it involves a maritime affair or something concerning on the Convention (interpretation or application).
