La peine de mort

Abstract

En s'interrogeant sur les peines de substitution qui peuvent remplacer la peine de mort, le XVIIIe siècle finit par fragiliser une certitude que Kant tenait encore pour inébranlable : si le criminel a commis un meurtre, il doit mourir, sans qu'aucune autre peine ne puisse satisfaire la justice. Étudiant la différence des approches et des contextes, les 20 essais réunis dans ce volume cherchent à répondre à la double question de savoir comment une réflexion sur la légitimité de la peine capitale a pu se former dans l'Europe des Lumières et en quoi les projets de substitution de la condamnation à mort par l'enfermement et les travaux forcés ont contribué à faire reculer l'idée, tenue comme acquise jusqu'au XVIIIe siècle, que le châtiment suprême constitue un impératif de justice.
