Dall’approvazione della riforma sanitaria alla decisione della Corte suprema: la parabola (inconclusa) dell’Obamacare

Abstract

L'articolo rappresenta un'analisi della riforma sanitaria approvata dal Congresso statunitense nel 2010 e nota come Obamacare. Nella prima parte del lavoro vengono esaminate le caratteristiche e i limiti del sistema sanitario degli Stati Uniti, evidenziando gli elementi che tradizionalmente ne hanno reso difficoltosa la modifica. Il lavoro prosegue con una descrizione della riforma approvata nello stato del Massachusetts nel 2006, riforma che ha costituito un modello per la successiva disciplina federale. Dell'Obamacare vengono poi analizzati l'iter di approvazione e il contenuto (mandato individuale, vincoli alle compagnie assicurative, health insurance exchanges, play or pay per le aziende di maggiori dimensioni, estensione del Medicaid). L'ultima parte del saggio esamina la decisione del giugno 2012 con cui la Corte suprema si è pronunciata sulla legittimità costituzionale dell'Obamacare, evidenziando le difficoltà attuative che da tale sentenza possono derivare.
