Abstract

La voce si articola in due diverse parti. Nella prima, scritta da Giuseppe Di Federico, viene presentato un quadro sintetico dei principali sviluppi della disciplina giudiziaria che si sono verificati in altri paesi democratici. Viene quindi effettuata una comparazione tra quegli sviluppi e quelli, piu` modesti, verificatisi in Italia. Nella seconda parte, scritta da Daniela Cavallini, vengono dapprima illustrate le caratteristiche strutturali e funzionali del sistema disciplinare italiano. Viene quindi fornita una sintetica presentazione degli orientamenti che emergono dall’analisi della giurisprudenza disciplinare, con particolare riferimento alle violazioni piu` rilevanti e cioe` i ritardi dei magistrati nell’espletamento di attivita` dovute, gli illeciti nell’esercizio dell’attivita` giurisdizionale (atto abnorme, violazione di legge, errore macroscopico) e le violazioni dei doveri di indipendenza, imparzialita` , riserbo e correttezza.
