Abstract

El artículo propone una interpretación del interés superior del niño y de la auto-nomía progresiva a partir de la Convención sobre los Derechos del Niño CDN y considerando las Observaciones Generales del Comité de los Derechos del Niño, con el fin de verificar cuál es el alcance aplicativo concreto de estos principios y cuál debería ser su impacto en todos los estados miembros. Partiendo de la idea de que la CDN es una fuente de rango jerárquico superior al derecho co-mún, se afirma que las normas de los Códigos Civiles, que no son susceptibles de interpretación conforme, deben considerarse derogadas y sustituidas por las normas y principios de la Convención. Se afirma que el ejercicio de la capacidad del menor ya no puede considerarse regulado por las normas del Código Civil en conflicto con los principios de la CDN, que deben considerarse derogadas y sustituidas por una norma que atribuya a la persona menor de edad con dis-cernimiento la capacidad de realizar todos aquellos actos jurídicos de la vida corriente propios de su edad y conformes con los usos sociales

he essay proposes an interpretation of the best interests of the child and progressive autonomy starting from the Convention on the Rights of the Child CDN and considering the General Observations of the Committee on the Rights of the Child, in order to verify what the concrete applicative scope of these principles is and what the impact should be in all member states. Starting from the idea that the CDN is a source hierarchically superior to ordinary law, it is stated that the norms of the Civil Codes, which are not susceptible to conforming interpretation, must be considered abrogated and replaced with the norms and principles of the Convention. It is affirmed that the exercise of the minor’s capacity can no longer be considered to be regulated by the rules of the Civil Code in conflict with the principles of the CDN, which must be considered abrogated and replaced with a rule that attributes to the person who is a minor with discernment the capacity to perform all those juridical acts of current life proper to his age and in conformity with social customs.
