Abstract

La compleja normatividad del derecho del consumo de la Unión Europea se caracteriza por algunos aspectos que son interesantes por sí mismos, y también porque permiten elaborar nociones de derecho contractual, a menudo, distintas, con respecto a las tradicionales. Especialmente eso se puede observar desde las perspectivas de la posición de las partes en el contrato; de las obligaciones en materia de información; de remedios en los casos de incumplimiento; del uso de las cláusolas generales; de efectos en favor de los terceros; etc. El utilizo de conceptos nuevos, coherentes con el marco jurídico comunitario y su objetivo de construir uno espacio jurídico continental, está cambiando el mismo paradigma de derecho contractual como lo conocemos en los códigos civiles nacionales.
