Il tema affrontato è quello della tutela dei creditori del legittimario che non reclami i diritti ereditari che gli spettino per legge e che il de cuius abbia tuttavia disatteso. In particolare, sono approfondite le modalità di impiego del rimedio previsto dall’art. 524 c.c., eventualmente in combinato disposto con il congegno predisposto dall’art. 481 c.c., anche in relazione all’ipotesi in cui il legittimario predetto sia assoggettato a procedura concorsuale. Si auspica, in conclusione, che la tendenza, attualmente in atto, a salvaguardare incondizionatamente le ragioni dei creditori venga rimeditata, almeno per contemperare, con tali ragioni, anche quelle di rispetto della volontà testamentaria.
This paper analyses the possible actions that creditors of the necessary heir can take when he doesn’t claim his rights on the decedent’s estate. The author considers the actions under Article 524 c.c., taking into account also Article 481 c.c. and tackles the issue of insolvency procedures initiated against the necessary heir. According to the author, the recent trend to protect creditors unconditionally should be reversed and creditors’ interests should be compared with the ones concerning the respect of the will.
