Abstract

Since the 80’s, after the decadence of the Welfare States and the beginning of the Democracy of Audience, several Latin-American countries undertook constitutional reforms in which mechanisms of direct democracy where incorporated, as the recall. This tool allows the citizens to dismiss their elected representatives through voting. Ecuador incorporated it in its national Constitution in 1998 though with restricted scope and several obstacles to its application. It was extended and simplified in 2008, reaching even the president. Since 2011 new legislative modifications eliminated some advances. This paper analyzes the design and changes of Ecuadorian recall and its utility to citizen control and to exit the crisis of representative’s legitimacy.

Desde los 80, tras la decadencia de los Estados de Bienestar y el auge de la Democracia de Audiencia, varios países latinoamericanos emprendieron reformas constitucionales en las que incorporaron mecanismos de democracia directa, como la revocatoria de mandato. Esta herramienta permite a los ciudadanos destituir a representantes electos a través del voto. Ecuador la incorporó en su Constitución de 1998 aunque con alcance restringido y dificultades de aplicación. En 2008 la amplió y simplificó, alcanzando al presidente. Desde 2011, nuevas modificaciones eliminaron algunos avances. Se analiza el diseño y cambios del revocatorio ecuatoriano y su utilidad para el control ciudadano y la salida a crisis de legitimidad de los representantes.

Desde os anos 80, após o declínio dos estados de bem-estar e da ascensão da Democracia de Audiência, vários países latino-americanos empreenderam reformas constitucionais que incorporaram mecanismos de democracia direta, como o revogatório. Esta ferramenta permite aos cidadãos demitir representantes eleitos através do voto. Equador incorporou-a em sua Constituição de 1998, embora restrita e con dificuldades na aplicação. Este artigo analisa o design e as mudanças do recall no Equador e sua utilidade para o controle social e para sair da crise de legitimidade representativa.
