Abstract

Este trabajo se centra en la responsabilidad internacional por negligencias médicas en la medicina estética desde el derecho internacional privado español, abordando el marco conceptual de esta disciplina, incluyendo las distinciones entre medicina curativa y satisfactiva, y examinando el concepto de negligencia médica seguido de los criterios de imputación. También se analiza la relación contractual entre médicos y pacientes/clientes y sus implicaciones legales y éticas, así como el entramado normativo que regula esta práctica a nivel nacional e internacional, incluyendo regulaciones específicas y estándares internacionales. Se realiza un análisis estadístico de los procedimientos estéticos a nivel global y nacional y se examina el aspecto internacional de las negligencias médicas, vinculado al derecho privado internacional y la responsabilidad civil, explorando vías de protección jurídica e indemnización por daños y perjuicios. Finalmente, se aborda la resolución de controversias internacionales, incluyendo la determinación de la competencia jurídica y la identificación del derecho aplicable en estos casos y en el proceso civil internacional.

This work focuses on international liability for medical negligence in aesthetic medicine from the perspective of Spanish private international law. It addresses the conceptual framework of this discipline, including distinctions between curative and cosmetic medicine, and examines the concept of medical negligence as also the attribution criteria. The contractual relationship between doctors and patients/clients and its legal and ethical implications are also analyzed, as well as the regulatory framework governing this practice at both national and international levels, including specific regulations and international standards. A statistical analysis of aesthetic procedures at global and national levels is conducted, and the international aspect of medical negligence is examined, linked to private international law and civil liability, exploring legal protection avenues and compensation for damages. Finally, the resolution of international disputes related to medical negligence is addressed, including the determination of legal jurisdiction and the identification of the applicable law in these cases and in international civil proceedings.
