Abstract

En principio toda obligación es pura y simple, es decir, aquella obligación con efecto inmediato e inminentemente exigible desde el momento en que mediante la autonomía privada de las partes o por cualquier otra fuente de las obligaciones nace a la vida jurídica. Cuando no se dan de esta forma se considera que la obligación está sometida a modalidades, circunstancias especiales o acontecimientos que pueden ocurrir o no ocurrir y que modifican tanto el nacimiento, extinción, ejercicio o exigibilidad de la obligación. La modalidad es una de las excepciones a la norma general que toda obligación es pura y simple; la modalidad se constituye entonces como excepción que puede nacer tanto de la ley como del convenio de las partes.
