Abstract

[ES] En nuestro trabajo de fin de grado analizamos el Impuesto sobre el Patrimonio, y más concretamente algunos problemas que derivan de la actual regulación de dicho impuesto. Además, estudiamos el Régimen jurídico del Impuesto sobre el Patrimonio, centrando nuestro estudio en dos cuestiones esencialmente; de un lado, nos cuestionamos que el Decreto-Ley sea el medio legislativo más idóneo para el restablecimiento del Impuesto sobre el Patrimonio; de otro lado, analizamos el ejercicio de la competencia normativa por las Comunidades Autónomas en esta materia, y realizamos un estudio comparativo al respecto. Por último, explicamos las conclusiones a las que hemos llegado con la realización y el estudio en profundidad de la temática de mi trabajo.

[EN] In this Final Degree Project, the Capital Gains Tax is going to be analysed. Specifically, some problems derived from the current legislation of this tax. In addition, the Legal Regime applied to the Capital Gains Tax is studied, essentially, focusing the analysis in two questions. In one hand, it is questioned the fact that the Decree-Law is the most suitable legislative method to re-establish the Capital Gains Tax. On the other hand, the exercise of the competing jurisdictions made by the Autonomous Communities in this topic is analysed elaborating a comparative study. Finally, derived conclusions reached with the accomplishment and the deep research of the topic of this project, are exposed.
