Abstract

El presente trabajo pretende abordar el Derecho de sucesiones desde la perspectiva de una realidad cambiante y partidaria de una mayor libertad de testar para el causante. Por lo que el objeto de esta exposición se centrará principalmente en la incidencia de la práctica jurídica (y no tanto del Derecho positivo) como forma de atribuir una cuota hereditaria superior, a expensas de eludir los rígidos muros que conforman el sistema de legítimas español. Tomará igual relevancia la jurisprudencia, con especial mención a la STS de 17 de enero de 2014, como apoyo absoluto e incondicional a la voluntad del testador y como elemento determinante de la naturaleza que caracteriza la denominada “Cautela Socini”

This paper aims to address the Probate Law from the perspective of a changing reality that favours greater freedom of will for the deceased . Therefore, the object of this essay will focus mainly on the impact of legal practice (and not so much of Positive Law) as a way of attributing a higher hereditary share, at the expense of circumventing the rigid walls that make up the spanish system of legitimate inheritances. Equally relevant will be jurisprudence, with special mention to the STS of January 17, 2014, as absolute and unconditional support of the testator's will and as a determining element of the nature that characterizes the so-called “Socini Clause”
