Abstract

RESUMEN: En un mundo donde la biotecnología forma parte del día a día de la sociedad, los ordenamientos jurídicos nacionales no podían desatender dicha realidad. Las grandes multinacionales biotecnológicas intentan aprovecharse de su peso en el mercado para influir en los criterios de patentabilidad de las oficinas de patentes. Ante esto, los Estados han elaborado un importante, pero insuficiente, cuerpo normativo orientado a regular esta materia sin olvidar los principios éticos y morales en los que se fundan sus sociedades. El presente trabajo pretende repasar los conocimientos actuales disponibles sobre este campo, tratando de plasmar la noción y alcance de las patente biotecnológicas, así como los textos normativos con repercusión en el marco europeo destinados a regular esta realidad. Se señalan además las peculiaridades de las patentes sobre genes en función a su origen animal, vegetal, fúngico o humano, así como los problemas de corte ético, moral y de orden público que acarrean. Por otro lado, se pone de manifiesto ciertas prácticas anticompetitivas llevadas a cabo por las empresas biotecnológicas, con especial referencia a las farmacéuticas.

ABSTRACT: Nowadays, biotechnology is part of the daily life of society, so national legal systems could not disregard this reality. The large biotechnology multinationals are trying to take advantage of their importance in the market to influence the patentability criteria of patent offices. Considering this, the States have developed an important -but insufficient- body of regulations aimed at regulating this matter without forgetting the ethical and moral principles on which their societies are founded. This project is aimed at reviewing either the current available knowledge in this field, attempting to express the notion and scope of biotechnological patents, and the normative texts which have an effect on the European framework destined for the regulation of this reality. Furthermore, it deals with the peculiarities of patents on genes according to their animal, plant, fungal or human origin, as well as the ethical, moral and public order problems that they involve. Additionally, it reveals certain anticompetitive practices carried out by biotechnology companies, especially by pharmaceutical ones.
