Abstract

La Corte Interamericana de Derechos Humanos a partir de la sentencia del Caso de los “Niños de la Calle” (Villagrán Morales y otros) Vs. Guatemala dotó de contenido al artículo 19 de la Convención Americana de Derechos Humanos, con base en la Convención de Derechos del Niño, utilizando además los instrumentos internacionales que la complementan. Con posterioridad a ello ha dictado una serie de resoluciones, dentro de las que destaca la Opinión Consultiva sobre la Condición jurídica y derechos humanos del niño, OC-17/2002, en la que resaltó la vigencia en la justicia penal juvenil de las garantías que rigen en el derecho de adultos, lo mismo que la existencia de garantías adicionales, consecuencia de la condición de menores de edad. A partir de lo anterior se han dictado diversas resoluciones de la Corte Interamericana que han tratado las detenciones masivas, el hacinamiento carcelario, la extensión de la prisión preventiva y la sanción privativa de libertad, etc. Igualmente se han declarado quebrantos a derechos humanos fundamentales, ocasionados por detenciones arbitrarias, práctica de la tortura y ejecuciones extrajudiciales. Sin embargo, sigue existiendo una gran diferencia entre los derechos establecidos en la Convención de Derechos del Niño y la vigencia de dichos derechos en la realidad latinoamericana.

The Inter-American Court of Human Rights, after the judgment on the Case of “Street Children” (Villagrán Morales et al.) vs Guatemala, provided content to Article 19 of the American Convention on Human Rights, based on the Convention on the Rights of the Child, also using international instruments that complement it. Subsequently, it has issued a number of resolutions, including the Advisory Opinion on the Legal Status and Human Rights of the Child, OC-17/2002, which highlighted the validity of the guarantees governing the laws for adults in juvenile criminal justice, as well the existence of additional guarantees arising from the status of minors. Based on the above, the Inter-American Court of Human Rights has issued several resolutions dealing with mass arrests, prison overcrowding, etc. Additionally, there have been statements on violations of fundamental human rights caused by arbitrary arrests, practice of torture and extrajudicial executions. However, there remains a large gap between the rights established in the Convention on the Rights of the Child and the validity of those rights in the Latin American reality.
