Abstract

En la lucha por la igualdad de género y la erradicación de la violencia motivada por esta característica innata del ser humano, el año inmediatamente anterior, se promulga la ley 1761 con el fin de penalizar la conducta intencional de matar a una mujer, por ninguna otra razón que su condición de ser mujer. En este contexto, analizamos los componentes subjetivos y circunstanciales que el legislador considero para este nuevo tipo penal, advirtiendo la complejidad probatoria en el desarrollo del proceso penal.

The struggle for gender equality and the eradication of violence motivated by this innate characteristic of humanity, the previous year, the law 1761 was promulgated to criminalize intentional conduct of killing a woman, by any another reason that your womanhood. In this context, we analyzed the subjective and circunstantial components that the parliament consider this new crime, suggesting the evidentiary complexity in the conduct of criminal proceedings.
