Abstract

Se indaga la esencia del Derecho Privado Europeo desde una doble perspectiva. No solo desde la normativa de armonización e integración de los distintos derechos privados y el llamado Derecho Constitucional europeo, sino también mediante el proceso inverso. Esto es la integración negativa determinada por el acervo principalmente jurisprudencial que impone límites a los distintos derechos privados especialmente en relación con la protección del mercado único. El nucleo de la conferencia trata de dar respuesta a la siguiente pregunta ¿Llevará este proceso a una codificación paneuroepea? Se recogen argumentos a favor de dicha opción, incluyendo el propio análisis econónmico como la protección de minorias hasta el resultado fallido del régimen de directivas. No obstante plantea el problema del alcance de dicha codificación que podría no ser completa de todo el derecho privado. Finalmente refiere la necesidad de atribuir a los jueces un papel importante en este proceso de construcción europea
