Los tribunales tutelares de menores surgieron a principios del siglo XX con el principal propósito de crear un sistema especializado que apartara a los menores de la justicia penal ordinaria. El objetivo fue crear un espacio diferente que permitiera darle un sentido educativo al castigo juvenil y de acuerdo con unos procedimientos adaptados para sus jóvenes destinatarios. El interés del menor se ha erigido siempre en el principio rector de todas las intervenciones y durante décadas se han ido desarrollando marcos legislativos, fundamentalmente desde instancias supranacionales, que han hecho posible el desarrollo y la consolidación de este sistema especializado. Sin embargo, el paso del tiempo ha demostrado que la adaptación al menor que se ha ido realizando en los sistemas de justicia juvenil ha ido modificándose; y el sentido de lo que significa un sistema adaptado al menor no es lo mismo hoy día que cuando se constituyeron los primeros tribunales tutelares. En este trabajo se presenta esa transformación histórica que permitirá comprobar no sólo cómo ha cambiado el modelo de justicia de menores y la finalidad que se le otorga al castigo juvenil, sino también la evolución del concepto infancia que se ha producido en la sociedad. Juvenile courts emerged at the beginning of the 20th century to separate juvenile offenders from adult criminal courts. The objective was to create a different space to provide an educative punishment and to develop procedures adapted for young people. The best interest of the child, promoted by international institutions, has been the main principle which guides all interventions involving children and young people. However, over the time we have seen that these adaptations have changed, and the meaning of the system which are adapted to the young people is different today than in the first juvenile courts. In this paper this historic transformation is featured, and it is shown how the model of the juvenile justice, the purpose of the juvenile punishment and the concept of childhood have changed through the time.
